Addendum to Final Report - MPCC 2007-003 - Concerning the Afghan Detainee complaint by Dr. Attaran

On March 16, 2011, the Military Police Complaints Commission (the Commission) received a further response from the Chief of the Defence Staff (CDS) to its December 31, 2008 Interim Report in respect of this complaint. This further response had been promised in the CDS’s letter to the Commission of February 23, 2009 and in the Canadian Forces Provost Marshal’s (CFPM) Notice of Action of April 3, 2009 in response to the Commission’s Interim Report.  In the interests of timeliness, the Commission proceeded to issue its Final Report in this case on April 23, 2009, but promised at that time to issue an addendum to the report following receipt of the CDS’s further response. The CDS’s further response relates specifically to the Commission’s recommendation in this report.

The CDS, in his letter of March 16, 2011, advised that a new command and control structure for military police is being put in place. Accordingly, the CDS advises that he has directed that

… on April 1, 2011, the CFPM is to assume full command of all military police (MP) who are directly involved in policing. In order to support CF operations while maintaining military police independence, the CFPM will detach MP elements to environmental, operational and other commanders under the operational command relationship for non-policing duties.
