Fynes – Determination on Public Funding

Dear Mr. Stannard,

As you know, we represent Mr. Shaun and Mrs. Sheila Fynes, the complainants, in matter of a Public Interest Hearing into the military police investigations relating to the death of Corporal Stuart Langridge. The said hearing is currently anticipated to commence the week of February 27, 2012.

At the October 19, 2011 case conference, we brought a motion for public funding for legal representation before the Commission. On October 26, 2011, in support of our motion, the Commission made a funding recommendation to the Government of Canada. Despite six (6) weeks having elapsed, the Government has yet to make a determination on this matter.

Since October 19, 2011, we have been provided with a large quantity of disclosure materials, and understand an even larger quantity to be forthcoming. Because of the costs involved, we are unable to undertake full and thorough review of these materials until we can confirm Government funding.

We respectfully request from for the Commission to request from Government an indication to when we might receive a determination on funding. If the Government is unable to take a position, we will be forced to make a motion for a delay, which, we suggest, should take place no later than January 3, 2012.
