Notice of Hearing - MPCC-2011-004 - October 6, 2011

In the matter of a conduct complaint under section 250.18 of the National Defence Act by Mr. Shaun Fynes and Mrs. Sheila Fynesand pursuant to subsection 250.43(1) of the National Defence Act, the Military Police Complaints Commission will conduct a Case Conference in the City of Ottawa in the province of Ontario, at 270 Albert Street, 10^th Floor, on October 19, 2011 at 10:00 AM.

The following issues will be addressed at the Case Conference:

• Legal representatives for the Parties who have chosen to retain counsel will be identified;
• The state of the documentary disclosure received by the Commission and available for disclosure to the Parties will be discussed;
• The Parties will be provided with an opportunity to advise of their views as to the scheduling of the hearing and to raise any preliminary issues;
• A date will be set for the beginning of the hearing of the evidence in this matter;
• The Motion by counsel for the complainants, Col (ret’d) Drapeau, requesting that the Commission issue a recommendation for public funding for legal representation for the complainants, will be heard by the Commission;
• Subject to prior notice to the Commission and to all Parties or by Motion to the Commission with proper notice, such further pre-hearing issues as may be identified by the Commission or by the Parties may also be dealt with.
