MPCC Response Letter – Request for an extension and proposal for a case management conference
Me Laverdière,
We have received your request for an extension of the deadline to produce the documents and materials requested in the summons dated July 29, 2025, whose deadline was previously extended to September 12 in the order I issued on August 29, 2025.
The request for an extension to comply with the summons is granted. The deadline set in the summons is therefore once again modified and is now set for October 3, 2025.
In your motion, you mention, among other things, difficulties in gathering the requested information, the efforts made, and the desire of the Canadian Forces Provost Marshal (CFPM) to personally participate in the decision-making process regarding the collection, analysis, and production of the information. These elements have been taken into consideration. Accordingly, I acknowledge that certain circumstances are beyond the CFPM's control. However, I note that some of the reasons cited in the request, such as the conference chaired by the CFPM and her vacation, are events that were foreseeable.
Please note that, barring exceptional circumstances, this extension will be the last. The timely progress of this matter is essential not only to ensure procedural fairness for all parties, but also to respect the principles of access to justice and to ensure effective and efficient case management.
Persistent delays in this case risk compromising the parties' ability to prepare adequately and may affect the next steps. I would appreciate it if you would take all necessary measures to meet the new deadline.
I also note that you mentioned the possibility of holding a case management conference to clarify certain points related to the requested documents and materials.
